Weekend Open Discussion

This is the time and place to post observations about your local areas, comments on news stories or the New Jersey housing market, open house reports, etc. If you have any questions you wanted to ask earlier in the week but never posted them up, let’s have them. Also a good place to post suggestions, requests for information, criticism, and praise.

For readers that have never commented, there is a link at the top of each message that is typically labeled “[#] Comments“. Go ahead and give that a click, you might be missing out on a world of information you didn’t know about. While you are there, introduce yourselves to everyone.

For new readers that have only read the messages displayed on the main page, take a look through the archives, a substantial amount of information has been put online in the past year. The archives can be accessed by using the links found in the menus on the right hand side of the page.

Oops…now, derivatives are beginning to blow up. All the hip, new trends start in Europe:

“The worst global financial crisis in 70 years arrived in Saint-Etienne this month, as embedded financial obligations began to blow up.

A bill came due for 1.18 million euros ($1.61 million) owed to Deutsche Bank AG under a contract that initially saved the French city money. The 800-year-old town refused to pay, dodging for now one of 10 derivatives so speculative no bank will buy them back, said Cedric Grail, the municipal finance director. They would cost about 100 million euros to cancel today, he said.

Saint-Etienne is one of thousands of public authorities across Europe that tried to shave borrowing expenses by accepting derivatives deals whose risks they couldn’t measure. They may be liable for billions of euros, according to the Bank of Italy and consulting and law firms in France and Germany. As global economies climb out of recession, the crisis is hitting Saint-Etienne in central France, Pforzheim in western Germany and Apulia, an Italian regional government on the Adriatic. They may pay for their bets into the next generation.”

No joke – In May of 1980, when Mt. St. Helens blew, I was living 40 miles south of Portland, Oregon – at least 100 miles away from Mt. St. Helens in Washington. Our cars and sidewalks were covered with the ash.

We kept the kids indoors. It was nasty stuff.

    HAMP Horror Show

Let’s sum up the relevant numbers, highest to lowest:

Number of homeowners in default or foreclosure: 7 million
Number of homeowners the White House hopes to help with HAMP: 4 million
Number of homeowners who’ve gotten trial modifications under HAMP: 1.4 million
Number of homeowners who’ve gotten permanent modifications: 230,801
So that’s 3.3% of homeowners in trouble that HAMP is actually helping.

Before they were approved for their permanent modification, their total debt load amounted to 75.7%. That’s 1.2 million people who are now emerging from purgatory and headed to Hades. Sooner or later, anyway. They have yet to receive their final notices.

Let me admit, I am baffled.

The SEC waits – what – 2 years after the fact to go after GS? Magnetar was doing the same thing – are they mentioned?

    Is this because:

    A. The Dems are worried about November?
    B. The Dems want to get the financial overhaul passed?
    C. Time to crash the markets?

And… Can the pension funds now go after WS for buying the recommended crap?

Will they all say the rating agencies messed up?

    Will anyone be prosecuted?

Since synthetic CDOs are created only when there is a buyer for the CDS, is Paulson in trouble too?

Would they have to prove that he knew (requested) the crap was in the CDOs knowing they would tank BUT calling them AOK?

Does anything happen here or is this similar the the disappointment I have been feeling about the Financial Crisis Inquiry Committee?

    or…
Does this mean the FCIC will start acting a bit more like the Pecorra Commission it was designed after?

    Anyone have an opinion?

The Charleston Gazette — Fraud: Wall Street quicksand

It began because the Cahaba River through Birmingham was polluted by sewage. Jefferson County officials decided to build modern sewer lines and treatment plants, at an estimated cost of $250 million.

“But in a wondrous demonstration of the possibilities of small-town graft and contract-padding, the price tag quickly swelled to more than $3 billion,” the article says. “County commissioners were literally pocketing wads of cash from builders and engineers and other contractors eager to get in on the project, while the county was forced to borrow obscene sums to pay for the rapidly spiraling costs.”

Eventually, 23 refinancing shuffles occurred — before the whole financial mess collapsed. “Between 2008 and 2009, the annual payment on Jefferson County’s debt jumped from $53 million to a whopping $636 million,” Rolling Stone relates. “. . . On a sewer project that was originally supposed to cost $250 million, the county now owed a total of $1.28 billion just in interest and fees on the debt.”

Local government was forced almost to a standstill. Mass layoffs of county employees occurred. The U.S. Securities and Exchange Commission charged JP Morgan Chase with fraud. The firm paid a $25 million fine, plus $50 million to help laid-off Alabamans, and also wrote off $647 million it might have collected. Mayor Langford drew a 15-year prison term for taking $240,000 in bribes. Influence-peddler Blount got four years in a cell. Banker LeCroy was jailed for a previous scam in Philadelphia.

Interesting that Fox News is trying to distance itself from the Tea Party movement

    http://www.nytimes.com/2010/04/17/us/17fox.html?src=twt&twt=NYTimesAd

Fox News executives said they canceled because they did not know that the Tea Party organizers were raising money based on Mr. Hannity’s widely promoted attendance at the rally. But Mr. Hannity’s producers at Fox were aware for months that tickets were being sold, said Chris Littleton, the president of the Cincinnati Tea Party, a nonprofit group. And Mr. Hannity mentioned the sales on his TV show a week ago.

The incident caused consternation inside Fox News Channel, which is a unit of the News Corporation, over its perceived closeness to the antigovernment Tea Party movement, especially in its highly rated opinion shows.

The network has faced regular accusations that it is promoting — not just covering — the Tea Party movement, something that its executives deny.

Responding to a question from the media watchdog group Media Matters last week, News Corporation’s chief executive, Rupert Murdoch, said, “I don’t think we should be supporting the Tea Party or any other party.”

for anyone thinking about mid-term elections … READ THIS!

    http://www.newyorker.com/talk/financial/2010/04/19/100419ta_talk_surowiecki

Even the high unemployment rate may be less important politically than you’d think. Seth Masket, a political scientist at the University of Denver, has found that, in midterm elections since 1950, there’s been no correlation between the unemployment rate and election outcomes. The key economic variable for voters, other studies show, has been income growth, or, more specifically, how fast per-capita G.D.P. is rising. In other words, if income growth is brisk enough, Democrats should benefit at the polls even if unemployment stays high. And Democrats do have an ace in the hole when it comes to keeping the economy moving: last year’s stimulus bill was backloaded, which means that close to five hundred billion dollars in stimulus money is still to be spent.

That backloading of the bill was good economics: with the Federal Reserve doing less to pump up the economy, an extra half-trillion dollars in fiscal stimulus will help pick up the slack. It was also good politics, since much of that money will be flooding into the economy during the key second and third quarters.

This is what someone wrote to me:

It is a “SYNTHETIC” CDO. Meaning the CDO is comprised of CDS contracts. For there to be CDS contract there has to be someone willing to short the securities. And guess what, I believe it is ok for Paulson to decide which securities he wishes to short. The buyers know there is someone on the other side of this bet. This is a witch hunt. Giving this witch hunt credence will embolden the continued destruction of capitalism by corrupt government. All for political gains?

  22. Cindy says:

    24 Make –

I get that about the synthetic CDOs. The implication by Felix Salmon @ 17 is that when being presented, the buyers were led to believe Paulson was interested in the long side of the trade. That ACA would simply be following a decision of a seasoned investor.

But as we know, Paulson was not “interested” in the CDOs as a money making proposition. Well, not long anyway.

The question comes down to whether there is fraud involved. Paulson supposedly helped choose the losers.

I just hope more of these trades (Magnetar etc. ) come to the forefront. It can’t hurt any.

One does wonder, is the SEC doing something NOW that there is the threat that a financial bill could lesson their power?

U.S. bank chief mobbed by angry borrowers …The JPMorgan Chase & Co executive was at a congressional hearing in Washington when a lawmaker asked him who mortgage borrowers could turn to if they felt his bank’s employees were not helping them hold onto their homes.

“Come to me,” said David Lowman, chief executive for JPMorgan Chase & Co’s home mortgage business in response to the question from Massachusetts Democrat Barney Frank.

Minutes later, around 50 borrowers burst from the audience and presented Lowman with a 6-page document alleging his bank reneged on a pledge to help struggling homeowners.

The activist who organized the protest said Lowman did not want to talk and left the hearing.

The question is was the bucket filled with ground chuck or filet and who was supposed to disclose what the bucket was filled with and did they?

Was there an independent party that rendered an opinion as to the quality of stuff put into the bucket or when individual portions of the contents of the bucket were sold off, did the sellers say point blank – caveat emptor?

Furthermore, I had heard that there was supposed to be an independent entity who decided what to put in the bucket but in fact, that may not have been the case.

This bucket may have been imported from rural america and if so, it’s possible someone forgot to empty the horse $iht out of it.

  32. Final Doom says:

Piling on. It’s the right thing to do:

“The Pandora’s box of the SEC’s action against Goldman, which if validated in court will effectively make the issuance of every hybrid CDO product quasi-illegal, will lead to an explosion of lawsuits against virtually any bank that was active in the structured finance space during the housing boom, adding to a fresh round of “non-recurring” charges to bank income statements. Case in point – Welt am Sonntag reports that the German government is considering suing Goldman Sachs, and has asked the SEC for information in its fraud case against the firm. According to the WSJ a spokesman for Angel Merkel said earlier: “First we must ask for the documents, then evaluate [them] and then decide about legal steps.” The action stems from the SEC’s disclosure the German IKB may have been illegally “taken advantage of” through Abacus, and probably other CDO transactions, leading to losses of $1 billion. In 2007 IKB had to be bailed out by the German government, in what some claim was the preamble to banking crisis that is now enveloping Europe (not sure if the sovereign catastrophe facing the EMU can also be blamed on Goldman’s CDO transactions, although Goldman will surely also be sued for that sooner or later). We have seen how eager Europe has been to scapegoat “speculators” and other Wall Street actors. We are positive that Germany will surely pursue action against Goldman as it will now provide a vent to pent up popular hatred of how the government has handled the crisis. At the end of the day, even if the SEC’s overture is nothing but a pr stunt cleverly orchestrated by Emmanuel Rahm, the unexpected fallout may well be where the real action is.”

There very well may be a rational explanation for why today’s fraud charges against Goldman Sachs Group Inc. should cause gold to fall.

But it’s not immediately obvious what that explanation would be, since gold would have been expected to rise in the face of such news. Anything like this that shakes confidence in the integrity of the financial system should, other things being equal, be good for gold — a store of value that is not dependent on any government or financial market.

  61. yo'me says:

Germany may take legal action against Goldman Sachs Group Inc. after the U.S. Securities and Exchange Commission said it was suing the company on fraud charges, government spokesman Ulrich Wilhelm said. The German financial regulator, Bafin, “will ask the SEC for information,” Wilhelm, main spokesman for Chancellor Angela Merkel, said today by phone. “Then we will look at the records and consider possible legal steps.”

Goldman was sued yesterday by U.S. regulators for fraud tied to collateralized debt obligations that contributed to the financial crisis. In the complaint, the SEC cited Dusseldorf- based IKB Deutsche Industriebank AG as a purchaser of part of the CDO at issue. In 2008, Germany’s state-owned KfW development bank pumped almost 10 billion euros ($13.5 billion) into IKB to shore up the German banking system. It’s too early to say whether any legal action will relate to IKB, Wilhelm said. “First we have to ask for information,” he said

Re Cuomo and the Congressional Dems and Financial Reform: You have to ask yourself is this going to be the real deal, or is it going to be the typical dog and pony show where the threat of true reform is made in an effort to extort campaign contributions from Wall Street much as was done with the Hedge Funds before the 2008 election (they threatened to change tax treatment of money earned from hedge fund managers to ordinary income, once the got enough campaign contributions, this PROBLEM (actually it’s frigging crime) disappeared). Given the fact they’ve only released complaints on one deal and only mention one low level employee I think we are seeing another dog and pony show to appease the voters while extracting cash before an election. In all likelihood there’ll be all kinds of “drama” in Congress the next few months but the bill will be “delayed” due to “partisan” wrangling.

    HEHEHE – Check this out…

    Simon Johnson: Baseline Scenario

“John Paulson Needs a Good Lawyer”

“John Paulson was not the trigger man – it was Goldman and its executives who withheld adverse information from customers. But the entire scheme was Mr. Paulson’s idea – if he was in any legal sense the mastermind ( obviously he was, but can you prove it beyond a reasonable doubt?) – Then he is looking at potential conspiracy to commit fraud.”

  71. Cindy says:

HEHEHE – Ah come on. We have to have some rule like “Good News Sunday” or something. A hopeful day.

Well….Where the he!! is the Financial Crisis Inquiry Committee with all of the Goldman stuff? If they step in here, I will be so pleasantly surprised.

On that note, I got the heartening news yesterday that the second coach I’ve worked with in three years has been arrested for selling kiddie p0rn. The whole Feds/seized computer/traumatized family thing…right in my own town.

I’m thinking of working uder the assumption that everybody I encounter is a sicko, until they prove otherwise.

Go ahead and entrust your kids to the coach/troop leader/kindly guy next door. Just don’t say you weren’t warned.

I have way too much experience dealing with these offenders to believe that its OK to trust and wait for them to make a funny move.
