New Jersey Liquor License Overhaul Signed.  Much More To It Than The Press Release

So it’s clear that New Jersey lawmakers are not happy that over 1,500 full alcohol plenary licenses are sitting unused for years, which can be a commercial impact to the townships who would rather see restaurants developed with the licenses.

As I interpret the legislation, an unused full liquor license is allowed to be “inactive” for 2 years, which can be extended to a third by the municipality. Before the final inactive license expiration, the license must be utilized or sold. 

For the existing inactive licenses, many of which have been inactive for decades…there are provisions in the new legislation to move them through the process towards expiration. Based on how long a license in inactive, it could have from 1 to 4 years to start utilizing or sell.

If a plenary licenses move to full expired status the license holder loses the license, and the municipality then can offer the license up to sale, typically in a “best price” auction.

I also wonder if the requirements of ”use it or lose it” starts bringing down the prices for full liquor licenses in New Jersey, as owners sitting on plenary licenses are effectively forced to sell the license or utilize in a business, in just the next few years.

As an example, regarding the traditional plenary (full alcohol) licenses…  This new law could have an immediate impact in towns like Harrison Township, where one business (Madison Marquette) has been sitting on FOUR plenary licenses for over 10 years… and the new legislation basically forces a “use it or lose it” set of requirements!

    The bigger story here is the licenses, not the craft alcohol changes.

    Opening up more licenses for small businesses and new restaurants in downtowns should be a top priority here. The mall licenses provisions reduce some pressure on licenses in mall-heavy towns, and town-to-town regime should see more licenses made available in certain parts of the state. The caps on pocketing are a great way to get people off their asses here. In the short-term, downward pressure on license prices.

    For the craft producers, many of us have already operated, to some extent, under the provisions that were finally formalized. Not necessarily new provisions here, just codifying what the intent of the original law was. All this really did was get the ABC out of the subjective rule making process.

    Anyway, NJ is bizzare in how it tries to shape society via force, and ends up actually creating vested interests benefitting from their regulations. Like Indian-owned gas station owners maintaining their racket and advantageous access to cheap labor via self service rules allegedly for public safety, but mostly keeping out more efficient and convenient new entrants. Or liquor license restrictions that probably originally were promoted on social concern reasons, but now again are hoarded to benefit the few that have them. Or a county that makes retail commerce illegal on Sundays, inspired by some religious motive, that’s again turned into something else, like a defense against more efficient 7-day competitors.
    What a bunch of corrupt hypocrites running NJ.

    No One: Paramus some years ago held a referendum on allowing Sunday shopping, and residents voted overwhelmingly to keep stores closed on Sunday. It may have been for religious reasons in the past, but now it’s for one day of peace and quiet with no traffic.

    You’re allowed to drive to the Garden State Plaza to watch a movie, or go to the nearby country club and play golf, but a busy family is only allowed to shop at the Mall’s Macy’s on Saturday, tough luck if that conflicts with your schedule – just kill more polar bears driving to the Short Hills mall!

    No One: Not disagreeing , just pointing out the residents did not want it, although with the hundreds of new residents that will be moving in to all the new apartments being built in Paramus there may be a push to revisit the Sunday no shopping issues. In the meantime, it’s Short Hills, Wayne, or Palisades mall in Rockland Co if people in Bergen want to shop on Sunday.

    Fundrise is the company. There are a lot of disillusioned investors opening up their fundrise accounts 1-3 years later with little to no appreciation. I haven’t read much into it, but seems like unseasoned operators fleecing new investors.

    Phoenix – Somehwat apropo, my wife read a Harvard Business Review book on leadership and women in the workplace. The book claims, referencing multiple studies, that women in supervisory and managerial roles are overly critical and harsh toward the women whom they supervise/manage, but not so to their male counterparts. Studies showed no similar bias when sexes were reversed (male manger, male employee).

Shocked at how messed up the ECAC standing are, but I guess the intersession caused a big disparity in games played among the teams. I think within a couple of weeks it will sort out, but there is actually quite a bit of parity. I assume that the ECAC is super weak this season. If the conference champion is Q’Pac, they might be the only Frozen Four invitee.
